On Wednesday 6/1/2011 I was in an accident that was not my fault. The woman who hit me rolled through a two way stop sign and hit me while i was driving through the intersection that had no stop sign. She was an insurance agent for Farmer's. The police were called and she admitted to rolling through the stop sign to the officer. I had a warrant out on me for an unpaid ticket, and apparently in STL when they issue a warrant they also suspend your license but i was unaware of my suspended license at the time. I was also unaware that my insurance had been lapsed at the time because my wife did not make the payment on it. If i reinstate it my agent says it will not show as having coverage at the time of the accident. I was not arrested, and i had to walk somewhere to get the keys to the car back from my wife, and when i came back i heard the woman saying that she was taking this to court. My wife feels like if i was driving with a suspended license its automatically my fault. My insurance agent thinks that my suspended license doesnt matter since she admitted to the police she ran the stop sign. My mother thinks i need to contact a lawyer, but im not sure if a lawyer can help. She also wants me to call the woman now and get her to have my car taken to a body shop and give me a rental car, but i feel like i have to make a claim first.
What is going to happen in this case with my license being suspended? Will she still have to pay for my car to be fixed, since she rolled through the stop sign?
Where should I start, what moves should i make now?
