Call your inspector and ask them.

my state no longer requires the check engine light to be off to pass inspection, they determined it is not a safety concern

Since I am not a mind reading wizard, how the heck should I know if it will pass?
A simple trip to the garage, any garage, and have it checked, likely for free, or buy a reader for twenty bucks and check it yourself. There is an app for that.
Know what the issue is. I had a check engine light go on for a loose fuel cap, but it needed to be cleared.

Te usual cause of the CHECK ENGINE LIGHT is a dirty sensor that makes it run TOO RICH! (too much fuel) so the O2 sensor gets agitated. Another cause, believe it or not is the use of very cheap OIL CHANGES that makes harmful vapors that clog up the sensors. This is an EASY FIX with ONE AN OF AMSOIL POWER FOAM and a little ambition! learn OR ask WHERE THE throttle body AND THE ile air control Valves ARE L
oCATED. If very CHEAP oil changes were EVER used, they will be fowled out with tarry baked i SLUDGE! The THROTTLE BODY has TWO waysides; th FRONT plate, and the back OF THE THROTTLE PLATE! They should BE hospital floor clean AT ALL TIMES! modern CARS ARE MEANT TO GO FOR 200,000 Miles AND MORE, SO IT IS very important THAT YOU KNOW WHERE THESE ITEMS ARE AND HOW TO CLEAN THEM! also REALIZE THAT YOUR CAR ACTUALLY HAS SPECIAL OILS TO USE AND THAT A 5W-30 OIL MEANT FOR A ford< IS NOT THE SAME AS THE 5w-30 made for a HONDA>I HATE this keyboard! Anyways, list car he or read your OWNER's MANUAL for the EXACT Specification oil to use for your car! An AUDI requires 502/505 oil, e.g. GM requires only DEXOS or better! ALso in this age only FULLY SYNTHETIC OILS should be used EVER! I HATE VALVOLINE cause most engine in the just yard got there using it along with PRESTONE COOLANT that NO factory anywhere on earth will use!!!! IT turns BACK into the sludge tar and wax it was made from! PENNZOIL is one of my favorites cause with poof of purchase, you can get 500,000 miles of use guaranteed. AMSOIL is VERY specail as well giving a full 250 mile interval for oil changes, and it WILL SAVE on gas along with other fully synthetic oils out there! I LOVE TOTAL ENERY OIL from Europe, but refined HERE in the states as well! THey nakes FOUR different formulaes depending upon WHAT CONTIENTE your car was MADE IN!. There IS actually oil made SPEIFICALLY to satisfy, FORD ENGINES< e.g. and one made for most EUROPEAN cas or domestic cars with EUROPEAN ENIGNES loilke the ECOTEC< which started life as a SAAB engine! THese oils will makde ZERO wax or sludge or deposits and keep sensros LEAN as you drie it along! WHEN you use AMSOIL POWER FOAM you can run it through the INTAKE SYSTEM to clean out the O2 sensors and he CATALYTIC CONVERTER as well! IT wil DISSOLVE the crap baking into your PISTON RINGS and SKIRTS and TOPS! A HUGE cloud of smoke conning from the tailpipe is the evidence that it is doing it's job! IT is FOUR TIMES more powerful than SEAFOAM! Running the POWER FOAM through the engine will usually clean the O2 sensor enough to shut off the CHECK ENGINE SYSTEM in a day or so as things mop up inside there!<<>> run the POWER FOAM through the PCV valv as well! You can follow up with GUMOUT SPRAY! SO there it is! Find an AMSOIL DEALERSHIP and consider using AMSOIL OIL as well with the AMSOIL filter, too! Nobody so far beats the 500,000 mile WARRANTY for engine coming from PENNZOIL company! LEAR to read the OIL Labels closely! Only a HANDFUL of oils will have YOUR CAR MAKERS SPECIFICATION NUMBERS on the label! BENZ requires only 229.03-05 oil! BMW requires only LONg LIFE 01 oil! DO NOT use ROYAL PURPLE either! The engineers that MADE your car tst ALL oils and have created those SPEC NUMBERS so you follow them to a tee! The IDLE AIR CONTROL VALVE or pricey THROTTLE BODY is where the final AIR/FUEL mixture occurs, especially in stop and go traffic! They MUST be as clean as possible! POWER WASH your engine to remove ALL forms of debris and fluids that MAY be leaking onto it! ALso remove debris and leaves from the veins leading to the HEATING SYSTEM! IT is VERY important to keep the engine bay SHOWROOM CLEAN so the engine can dissipate HEAT evenly! Do NOT be afraid to do his >>>You CANNOT harm anything cuz the ignition system is SEALED under the valve cover on most engines! READ THSI AgAIN to fully get it! The THROTTLE BODY and IDLE AIR CONTROL VALVES control the air/fuel mixture controlled by the COMPUTER! So these pars MUst BE KEPT clean at all times! the USE OF FULL SYNTHETIC OIL<,specially the ones formulated from Germany, will increase FUEL MILEAGE: protect the EXHAUST SYSTEM< and improve ALL drivability issues as the T body also MAY control SHIFTING POINTS! BE ASSURED that a CHECK IENGINE LIGHT is telling you SOMETHING< and that usually it means a FULL CLEANING is in order, os that you hae a few parts to change to make the engine HAPPY again!

In Ontario, that's an automatic fail.

Possibly. I know it would pass the test here. Only light that stops you here is an airbag light

Hi No it needs to be serviced first because it could be a faulty component that causes a failure in the test,

Ask somebody in your mystery location, dumbass.

Where I live, they don't care about the sensor being on, as long as the actual functions for safety are working, breaks, lights, wipers, and speedometer being the main things here.
Where you live may be different, as all states can have different laws. I will assume you are in the U.S.
You did not tell anyone where you live, so we can only make a rough guess.
What you need to do is simply ASK at whatever place you would go to for inspection what is considered for passing.
